Manager Submission Confidentiality Undertaking

How the Trust treats factsheets, presentations, due diligence materials and related information submitted by investment managers.

Purpose of Submission

GKAF Family Trust receives manager factsheets, presentations, due diligence materials and related information solely for its own internal investment research, manager assessment, portfolio construction and trustee decision-making.

Confidentiality

Information submitted to the Trust will be treated as confidential. The Trust will not sell, license, publish, market, distribute, benchmark, package, database, commercially exploit or otherwise make available any submitted factsheet, presentation, performance information, strategy description, risk data, fee information, contact details or related manager material to third parties.

Use of Information

Submitted materials will be used only for the Trust's own purposes, including investment research, due diligence, allocation assessment, ongoing monitoring, portfolio review and related trustee governance.

Access to Information

Access to submitted materials will be limited to the trustees, directors, authorised representatives, professional advisers and service providers who need access for the Trust's proper administration, investment research, legal, tax, accounting, compliance, operational or technology purposes. Any such access will be on a confidential and need-to-know basis.

Permitted Disclosures

The Trust may disclose information where required by law, regulation, court order, HMRC, a competent authority, a bank, custodian, auditor, legal adviser, tax adviser, accountant or other professional adviser acting for or assisting the Trust.

Data Protection

Where submitted materials contain personal data, such personal data will be processed in accordance with applicable UK data protection requirements, including the UK GDPR and the Data Protection Act 2018. In particular, the Trust will seek to apply the principles of lawfulness, fairness and transparency, purpose limitation, data minimisation, accuracy, storage limitation, integrity and confidentiality, and accountability.

No Obligation to Review or Allocate

Submission of materials does not create any obligation on the Trust to review the materials, respond to the manager, carry out due diligence, make an allocation, maintain an allocation, or provide reasons for any decision. The Trust may decline or cease review at any time.

Manager Responsibilities

Managers should submit only information that they are authorised to provide and should not submit inside information, confidential client information, personal data that is not necessary for review, or any material that cannot lawfully be provided to the Trust for investment research and due diligence purposes.
